Abstract
Tema ovog diplomskog rada je zakonski prikaz i analiza kaznenog djela zlostavljanja na radu iz članka 133. trenutno važećeg Kaznenog zakona, odnosno zaštita radnika kroz članak 114. Kaznenog zakona iz 1997. godine. Rad započinje definiranjem pojma mobbing odnosno zlostavljanja na radu te se nastavlja njegovom klasifikacijom ponuđene od strane stručnjaka koji se bave zaštitom radnika. Slijedi prikaz zakonskih rješenja vezanih uz mobbing u zemljama Europske unije, a nakon toga posebna pozornost posvećuje se razlikama i sličnostima postojećih pravnih rješenja u svezi zlostavljanja na radu u Republici Hrvatskoj. Glavni dio rada odnosi se na istraživanje sudske prakse te analize postojećih presuda vezanih za zabranjena ponašanja na radnom mjestu.
Abstract (english)
The main issue of this paper is to analyze and review criminal offence of work maltreatment based on article 133 of Criminal Law from 2011 that is protection of workers by article 114 of Criminal Law from 1997. The paper begins with definition of mobbing – workplace mistreatment and continues with its classsification. The focus is on analysis of legal solutions regarding mobbing - workplace mistreatment in countries of European Union, existence of similarities and differences of criminal legal protection of workers in the Republic of Croatia. A central part of this paper is the reasearch of case law regarding the prohibited behaviours in a workplace and its analysis.
