Actio civilis signifies claims that fall under civil law, but for process economics reasons are joined with criminal proceedings. The closest to that term is civil claim in criminal proceedings, however considering the close connection with confiscation of property gain, and the great presence of civil regulations, it is neccessary to point out the stated measure. What is important to emphasize is that both institutes have the goal of achieving some sort of compensation. Civil claim in criminal proceedings compensates the injured person and the confiscation of property gain „compensates“ the Republic of Croatia, although that couldn't be called compensation in the true sense of the word because that gain is taken away and paid into the budget of the Republic of Croatia. Both proceedings are proceedings that are joined with criminal proceedings, respectively discussing about them doesn't present a process assumption, both are initiated with the proposition of the authorized person and ultimately it is neccessary to emphasize the advantage of the civil claim in criminal proceedings before a measure of taking away property gain. However, both institutes in practice try to achieve the principle that nobody can keep the property gain realized by felony.
