Abstract
Tema ovog rada je obavljanje kaznenog progona, s posebnim osvrtom na radnje koje poduzima drţavni odvjetnik tijekom prethodnog postupka. Rad je koncipiran tako da započinje prikazom pojma kaznenog progona i osoba koje su ovlaštene na poduzimanje kaznenog progona, a zatim se iznose načela koja su ključna za obavljanje funkcije kaznenog progona. U središnjem dijelu rada prikazano je postupanje drţavnog odvjetnika tijekom prethodnog postupka, od trenutka zaprimanja kaznene prijave, pa do poduzimanja dokaznih radnji kada je počinitelj nepoznat. Budući da su tijekom istraţivanja provedene dokazne i posebne dokazne radnje, prikazano je postupanje drţavnog odvjetnika prilikom njihovog provoĎenja. Na samom kraju rada, analizirana je drţavnoodvjetnička praksa vezana uz postupanje po zaprimljenoj kaznenoj prijavi.
Abstract (english)
The theme of this thesis is criminal prosecution, with a special reflection on the actions that are done by the state attorney during the preliminary proceeding. The thesis begins with explaining the term „criminal prosecution“ and the people who are authorised to carry out criminal prosecution, and then are listed the principles that are crucial to the function of criminal prosecution. In the main part of the thesis the actions of the state attorney during the preliminary proceeding, from the moment of receiving a criminal charge all the way to evidence gathering when the perpetrator is unknown are described. Considering that during the inquiry evidence gathering and special evidence gathering are carried out, actions of a state attorney during them are shown. At the very end of the thesis case law regarding a state attorney during the actions he carries out after receiving a criminal charge is analysed.
