Abstract
Profesionalni sportaši u odnosu na svoje klubove imaju različiti status u različitim državama; mogu biti podvrgnuti primjeni radnog prava ili pak građanskog prava, ovisno o tome jesu li sklopili ugovor o radu ili neki drugi ugovor. U ovome radu nastoji se prikazati položaj sportaša kao radnika u profesionalnom sportu, što je između ostalog potvrđeno u europskoj sudskoj praksi. Radno pravo podrazumijeva i primjenu odredbi o prestanku radnog odnosa, iz čega se za potrebe ovog rada ističe otkaz ugovora o radu, kao jednostrano očitovanje volje kojim prestaje radni odnos. Kao mogući razlog otkaza ugovora o radu sportaša analizira se doping, tj. korištenje zabranjenih sredstava i metoda u sportu za postizanje boljih rezultata. Pored otkaza ugovora o radu, razrađene su i druge posljedice dopingiranja sportaša, kao što su gubitak sponzorstva i moguća kaznena ili prekršajna odgovornost.
Abstract (english)
Professional athletes in relations with their clubs have different status in different countries; they may be subject to the application of labour law or civil law, depending on whether they have entered into an employment contract or some other type of contract. This paper strives to present the appearance of athletes as workers in professional sport, which is confirmed in European case law. Labour law includes application of the provisions related to the ending of employment relations, from which, for the purposes of this paper, the termination of employment contract is pointed out as a unilateral manifestation of the will by which the employment relation is terminated. Doping, i.e. the use of prohibited substances and methods in sport for achieving better results, is analysed as a possible reason for the termination of the athletes’ employment contract. In addition to the termination of the employment contract, other consequences of doping are brought out, such as the loss of sponsorship and possible criminal or misdemeanour liability.
