Abstract
Pravo građenja definira se kao ograničeno stvarno pravo koje ovlašćuje svog nositelja da na površini tog zemljišta ili ispod nje ima vlastitu zgradu, a svagdašnji vlasnik tog zemljišta dužan je to trpjeti. U pravni sustav Republike Hrvatske uveden je 1997. godine Zakonom o vlasništvu i drugim stvarnim pravima kojim se regulira način njegova osnivanja, upis, prava i obveze vlasnika zemljišta i nositelja prava građenja te njegov prestanak. Nositelj prava građenja može steći pravo tek nakon dvostrukog upisa u zemljišne knjige. Bitno je naglasiti da u korištenju institutom strani državljani, pa i državljani članica Europske unije su izjednačeni sa hrvatskim državljanima u stjecanju vlasništva nekretnina bez da ispune posebne pretpostavke.
Abstract (english)
Construction right is defined as a limited property rights who entitles its holder to build and have personale building on the land or beneath it, and the owner of that land parcel has to abide it. In the legal system of the Republic of Croatia was introduced in 1997 by the Act on ownership and other real rights wich regulate his way of establishment, registration, rights and obligations of landowners and holders of construction rights and termination. The holder of construction right can acquire this right only after a double registration in the land register. It is important to accent that in the use of the institute foreign citizens, including citizens of European Union member states are equal to Croatian citizens in acquisition of property ownership without special presumption.
