Abstract
Potrošačka on-line kupoprodaja i plaćanje kao složeni pravni odnos, očituje se u nizu podređenih pravnih odnosa koji čine neodvojivo povezane elemente. Promatrani ugovor primarno se ostvaruje na virtualnoj, mrežnoj razini elektroničke trgovine te istododno podliježe uređenju različitih pravnih propisa. Elektronički oblik ugovora sklopljenog posredstvom Interneta i modalitet izvršenja novčane obveze potrošača kroz elektroničko plaćanje, uvjetuje prioritet primjene posebnih propisa koji sadrže određene pravne instrumente kojima se potrošači štite kao specifična ugovorna strana. Posebno ugovorno pravo potrošača sadrži pravne mehanizme koji ustanovljuju viši standard zaštite potrošača, koji se štite kao ekonomski slabija strana ugovora. Ugovorna neravnoteža na štetu potrošača, negativno utječe na cjelokupno gospodarstvo te predstavlja jedan od razloga stvaranja sustava zaštite potrošača. Iznimno je važno odrediti pravilnu hijerarhiju primjene pravnih propisa koji se primjenjuju na potrošački ugovorni odnos kako bi se izbjegle negativne posljedice nesistematiziranog uređenja ugovornog prava potrošača unutar pravnog sustava Republike Hrvatske. Prioritet primjene imaju posebna pravila potrošačkog prava, iako se u praksi potrošači štite kao svaka druga ugovorna strana temeljem općih pravila obveznog prava. Sukladno navedenom, glavni cilj rada je u osnovnim crtama prikazati pravno uređenje osnovnih segmenata potrošačke on-line kupoprodaje i plaćanja s naglaskom na zaštitu potrošača putem posebnih pravnih instrumenata.
Abstract (english)
Consumer online purchase and payment as complex legal relations are manifested in a sequence of subordinated legal relations which make inseparably connected parts. The contract in question is primarily present in a virtual electronic commerce but at the same time it is proscribed by different provisions. Electronic contract concluded via the Internet and fulfilment of consumer’s pecuniary obligation in a form of electronic payment demands application of special provisions which protect consumers as unequal contract party. Consumer contract law consists of legal rules which establish higher standard of consumer protection. Contractual disbalance which is detrimental for consumers have negative effects on whole economy and it represents one of the reasons of the establishment of consumer protection law. To avoid negative consequences of inadequately regulated consumer relations in law system of the Republic of Croatia, it is of the highest importance to determine proper hierarchy of legal rules which are applicable on consumer contracts relations. Special rules of consumer law have the priority of application although in practice consumers are protected as any other party to a contract through the general provisions of the obligation law. In conclusion, the goal of this paper is to give an overview of the legal system of consumer online purchase and payment with an emphasize on protection of consumers through special legal institutes.
