Abstract
Oduzimanje slobode od strane policije predstavlja vrlo „osjetljiv“ trenutak za pritvorenika jer gubi kontakt s vanjskim svijetom i neka od njegovih temeljnih prava mogu biti ugrožena. Kako međunarodno tako i domaće pravo je bilo svjesno potrebe da se pravilno reguliraju policijski postupci kako bi se zajamčila prava svih pritvorenika. Doneseno je nekoliko međunarodnih konvencija kako bi se utvrdili minimalni standardi za zaštitu ljudskog dostojanstva. Jedan od tih dogovorenih instrumenata je i Europska konvencija za zaštitu ljudskih prava i temeljnih sloboda, koja je odobrena u okviru Vijeća Europe, te je od iznimne važnosti za ovo područje. Osim međunarodnih instrumenata tu su i propisi Republike Hrvatske koji uređuju navedenu problematiku. Jedan od njih je i Zakon o policijskim poslovima i ovlastima koji posebno uređuje ovlasti i postupanja od strane policijskih službenika.
Abstract (english)
Deprivation of liberty by the police is a very "sensitive" moment for a detainee because he loses contact with the outside world and some of his fundamental rights may be compromised. Both international and domestic law were aware of the need to properly regulate police procedures in order to guarantee the rights of all detainees. Several international conventions have been adopted to establish minimum standards for the protection of human dignity. One of these agreed instruments is the European Convention for the Protection of Human Rights and Fundamental Freedoms, which has been approved by the Council of Europe and is of great importance in this area. In addition to international instruments, there are also regulations of the Republic of Croatia that regulate this issue. One of them is the Law on Police Affairs and Powers, which specifically regulates the powers and actions of police officers.
