Abstract
Intelektualno vlasništvo čine pravna pravila koja uređuju način stjecanja isključivog prava korištenja intelektualnih tvorevina i način zaštite od neovlaštenog korištenja. Ovim radom ukazuje se na važnost patenta, kao oblika intelektualnog vlasništva kojim se štiti kreativna ili stvaralačka realizacija neke ideje, odnosno izum. Posljednjih nekoliko desetljeća, zbog rasta međunarodne trgovine, internacionalizacije ekonomije i razvoja tehnologije, zaštita patenta od krivotvorina i neovlaštenog korištenja postaje sve veći problem. Iz tog razloga se patentnoj zaštiti posvećuje velika pozornost na međunarodnom i europskom planu, ali i na području Republike Hrvatske što pokazuje usvajanje novog Zakona o patentu NN 16/2020. Rad je koncipiran u nekoliko cjelina koje su detaljnije objašnjene u uvodnom dijelu rada s naglaskom na patent i patentnu zaštitu.
Abstract (english)
Intellectual property consists of provisions regulating the manner of acquiring of the exclusive rights to exploitation of intellectual creations and the manner of protection against unauthorized use. This paper points out the importance of a patent, as a form of intellectual property that protects the creative realization of an idea, i.e., of an invention. In recent decades, due to the growth of international trade, the internationalization of the economy and the development of technology, patent protection against counterfeiting and unauthorized use has become an increasing problem. For this reason, great attention is paid to patent protection at the international and European level, but also in the Republic of Croatia, which is evident by the adoption of the new Patent Act (Official Gazzete 16/2020). The paper is divided into several selections which are explained in more detail in the very introductory part of the paper, with an emphasis on the patent itself and patent protection.
