Abstract
Ugovori na daljinu dio su pravnog sustava Europske unije te se zadnjih četiri desetljeća razvijaju pod okriljem prava o zaštiti potrošača. Ulazom u Europsku uniju Republika Hrvatska priznaje i potpuno preuzima pravnu stečevinu unije pa se time i obvezuje preuzeti i poštivati odredbe o zaštiti potrošača, uključujući odredbe o ugovorima na daljinu, koji su tema mojeg rada. Ugovori na daljinu prvi su puta uređeni Direktivom 97/7/EZ Europske Unije 1997. godine. Stvaranje unutarnjeg tržišta i njegovo konsolidiranje te slobodno kretanje roba unutar Unije postavljeni su kao glavni cilj. Točno dva desetljeća svjedoci smo razvoja ugovora na daljinu, kroz brojne izmijene i donošenja novih regulacija, dolazimo do danas najrelevantnijeg pravnog izvora – Direktive 2011/83/EU iz 2011. godine koja ugovore na daljinu svrstava u okvir zaštite prava potrošača.
Abstract (english)
Distance contracts are a part of the EU legal system and have been developing under the protection of consumers' rights for the past four decades. By entering the European Union, Republic of Croatia recognizes and fully assumes the acquis communautaire and it must comply with consumer protection provisions, including provisions on distance contracts, which are the subject of my work. Distance contracts were for the first time regulated by Directive 97/7/EC of the European Union in 1997. The creation of the internal market, its consolidation and the free movement of goods within the Union were set as the main objectives. For exactly two decades, we are witnessing the development of distance contracts, through numerous changes and new regulations, we come to today's most relevant legal source - Directive 2011/83/EU of 2011, which sorts distance contracts within protection of consumers' rights.
