Abstract
Rad se bavi privremenim mjerama, kao mjerama osiguranja tražbina u hrvatskom zakonodavstvu, konkretnije u ovršnom postupku. Prvenstveno se govori o pojmu samog instituta privremenih mjera u ovršnom zakonu. Zatim se, prolazeći kroz odredbe Ovršnog zakona, detaljnije pojašnjavaju zajedničke odredbe koje se primjenjuju prilikom određivanja privremenih mjera radi osiguranja novčanih i nenovčanih tražbina. U radu se radi distinkcija između regulacijskih mjera, privremenih mjera radi osiguranja novčanih tražbina te privremenih mjera radi osiguranja nenovčanih tražbina i pobliže se analiziraju primjerično navedene mjere iz Ovršnog zakona. Konačno, autor u djelu uspoređuje privremene mjere u ovršnom postupku te mjera radi osiguranja imovinskopravnog zahtjeva te radi osiguranja oduzimanja imovinske koristi predviđene Zakonom o kaznenom postupku te autor uspoređuje institut privremenih mjera u njemačkom i hrvatskom pravu
Abstract (english)
This paper deals with interim measures, as measures which serve the purpose in securing claims in Croatian legislation, more specifically in enforcement procedures. Firstly, the concept of the interim measures in the Enforcemet Act is discussed. Then, going through the provisions of the Enforcement law, the common provisions that apply when determining interim measures to secure monetary and non-monetary claims are clarified in more detail. The paper distinguishes regulatory interim measures, interim measures to secure monetary claims and interim measures to secure non-monetary claims and analyzes the examples of interim measures in the Enforcement Act in more detail. Finally, the author compares interim measures in enforcement proceedings and interim measures which secure indemnification claims and which secure the confiscation of pecuniary benefit in the Criminal Procedure Act and the author compares interim measures in German and Croatian law.
