Abstract
Article 17 of the Directive on Copyright in the Digital Single Market presents a major change in how the European Union approaches copyright infringements committed on major internet platforms. The Article establishes a new and special kind of regime to address the existing imbalance of power and influence, as well as the ever-increasing ‘value gap’ between the platforms and the authors who post on them. However, whether the EU did this in an optimal, fundamental-rights friendly kind of way is and continues to be widely disputed, even after the CJEU issued its stance, proclaiming that the Article provides sufficient safeguards to fundamental freedoms of users. Should we leave the act of balancing between colliding rights to the platform providers? Can we expect the users to be motivated and knowledgeable enough to complain to unlawful censorship? How can the whole system be (effectively) supervised? These are just some of the questions addressed in the thesis. And to accomplish this task, we start centuries in the past, at the heart of copyright philosophy and its underlying bargain. Afterwards, we examine this Article in detail to see where it fits in the existing conceptual and theoretical framework, followed by an analysis of possible improvements to the system. Lastly, the thesis finishes by examining the anticipated impact of the CJEU’s judgement proclaiming this Article reconcilable with the fundamental freedoms of users, predominantly, the freedom of expression. The thesis highlights some of the most prominent issues associated with the Article and offers possible improvements an all identified fronts, hopefully inspiring future discussion and action.

Članak 17 Direktive o autorskom pravu i srodnim pravima na jedinstvenom digitalnom tržištu učinio je značajan iskorak u dotadašnjem pristupu Europske Unije povredama autorskog prava na internetu. Ovaj članak je uspostavio novu i posebnu vrstu režima s ciljem uspostavljanja ravnoteže moći i utjecaja te odgovaranja na rastuću nejednakost i nepravednost pri raspodjeli vrijednosti stvorene dijeljenjem sadržaja na internetskim platformama. S druge strane, ukoliko tekst članka 17 nije ispravno implementiran u nacionalno pravo, isti nije dostatan kako bi se osiguralo poštivanje temeljnih prava i sloboda korisnika na društvenim mrežama. Iz tog razloga ovaj članak je učestalo kritiziran od strane pravnih stručnjaka, čak i nakon što je i Sud EU-a proglasio sam članak dostatnim za zaštitu tih prava i sloboda. Trebamo li prepustiti odgovornost za postizanje ravnoteže između suprotstavljenih interesa autora i korisnika usluga pružateljima usluga? Možemo li očekivati od korisnika usluga da budu dovoljno motivirani, stručni i savjesni da prigovore na nelegitimnu cenzuru njihovog sadržaja? Kako cijeli sustav može bit efektivno nadziran? Ovo su samo neka od pitanja u središtu ovog rada. U cilju pružanja odgovora na ista, rad započinje analizom filozofije autorskog prava, koja može razjasniti u kakvom se odnosu nalaze spomenuti suprotstavljeni interesi te kako su postojeće napetosti bile riješene u prošlosti. Nakon toga, iznesena je detaljna analiza samog članka, njegovog odnosa sa postojećom teorijskom i konceptualnom podlogom, te načina na koji bi sustav mogao biti poboljšan. Naposljetku su analizirane očekivane posljedice presude Suda EU-a, kojom je proglašena valjanost članka 17, čiji su uvjeti ocijenjeni dostatnima za osiguranje poštivanja prava na slobodu izražavanja i informiranja korisnika usluga te uspostavljanje pravedne ravnoteže između tog prava i prava intelektualnog vlasništva. Sukladno svemu navedenom, cilj rada je istaknuti neke od problema koji se mogu pojaviti prilikom implementacije članka u nacionalno pravo te ponuditi moguće odgovore na prethodno postavljena pitanja, a sa ciljem pridonošenja zaštiti prava korisnika te uspostavljanja pravedne ravnoteže između suprotstavljenih interesa.
