Abstract
Predmet ovog završnog rada pravni je institut izdvojenog mišljenja. Izdvojeno mišljenje definira se kao mišljenje jednog ili više sudaca koji se ne slažu s odlukom većine. Izdvojeno mišljenje, prema tradiciji, institut je comm law sustava koji se postupno proširio na kontinentalni sustav. Postoje dvije vrste izdvojenih mišljenja: izdvojeno mišljenje kod kojeg sudac prihvaća odluku o meritumu, ali se ne slaže s obrazloženjem i izdvojenog mišljenje kod kojeg se sudac ne slaže s većinskim i svoje glasovanje obrazlaže u posebnom pisanom mišljenju. Institut je doživio promjene tijekom povijesti i postoje razlozi koji mu idu u prilog i koji su protiv njega. Na Ustavnom sudu Republike Hrvatske izdvojena mišljenja su dopuštena kao i njihovo objavljivanje, a počela su se sve više primjenjivati i u praksi.
Abstract (english)
The subject of this graduate thesis is the legal institute of dissenting opinion. A dissenting opinion is defined as the opinion of one or more judges who disagree with a majority decision. A separate opinion according to tradition is the institute of the comm law system, which has gradually expanded to the continental system. There are two types of dissenting opinions: the first type is a dissenting opinion in which the judge accepts the decision on the merits but does not agree with the reasoning, and the second type of dissenting opinion is an opinion in which the judge disagrees with the majority and explains his vote in a separate written opinion. The institute has also undergone changes throughout history, and there are arguments in its favour that are against it. At the Constitutional Court of the Republic of Croatia, dissenting opinions were allowed as well as their publication, and in practice, they began to be applied more.
