Abstract
Danas se gotovo svaki čovjek na planeti bavi sportom, bilo aktivnim ili pasivnim putem. Sport postaje sve važniji element u žţivotu ljudi, kod starijih osoba on se očituje više na amaterskoj razini, dok se mlade osobe prepuštaju kako amaterskoj razini tako i profesionalnoj. Radnopravni status maloljetnika u sustavu sporta vrlo je kompleksna i problematična tematika. Velik broj maloljetnih sportaša svakodnevno sklapaju sportske ugovore s raznim profesionalnim klubovima i posrednicima. Iako su u teoriji sportskopravni odnosi maloljetnih sportaša vrlo dobro zaštićeni, u praksi je stanje puno drugačije, i nažalost ne ide na ruku mladih sportaša. Ovaj rad bavi se analizom radnopravnog statusa maloljetnika u sustavu sporta, odnosno tematika je usmjerena na maloljetničke sportskopravne ugovore. Početni dio rada usmjeren je na teorijski dio radnog odnosa i sportskog prava. Slijedom navedenog, u radu se obrađuju pojmovi maloljetnika, sportaša/ice te sportskih ugovora. Nadalje, detaljnije su prikazane pretpostavke koje se moraju ispuniti kako bi mogli govoriti o pravno valjanom ugovoru maloljetnika u sustavu sporta. Također, bit će riječi i o zakonskim odredbama koje dovode do pravne nesigurnosti i neusklađenosti kada govorimo o sportskim ugovorima maloljetnika. Posebna pozornost skrenuta je na autonomne akte nacionalnih sportskih saveza u kontekstu ugovora maloljetnika u sportu, gdje se detaljnije obrađuju njihove odredbe. U konačnici bit će govora o pravnoj zaštiti maloljetnih sportaša u okviru međunarodnih sportskih organizacija te na razini Europske Unije.
Abstract (english)
Today almost every human being on planet participate in sport, whether active or in passive way. Sport becomes an increasingly important element in people's lives, older population engages more on amateur level while the youth population engages both amateur and professional. Labour law status of minors in the sports system is very complicated and complex theme. A great number of juvenile athletes daily signs sports contracts with various professional clubs and managers. Although the relations concerning minors are very well regulated in legal theory concerning sport, in practice the situation is very different, and unfortunately it is not in favour of minors. This graduate thesis presents an analysis of labour law status of minors in the sports system, precisely sports contracts of minors. The initial part of the paper is focused on theoretical view of labour part and sports law. Furthermore, paper analysis the concept of juvenile, an athlete and sports contracts. In addition, author presented certain assumptions that must be fulfilled so that sports contract of minors could be legally valid. Also, there will be a word about legal provisions that leads to legal insecurity when we talk about sports contracts of minors. Special attention is focused on the relevant regulations of the national sports federations in the context of sports contracts of minors. In the end, there will be a talk about legal protection of juvenile athletes within the framework of international sports organizations and at European Union level.
