Abstract
Ovaj diplomski radi bavi se ponavljanjem postupka u parničnom postupku. Ponavljanje postupka predstavlja poseban pravni lijek koji pripada skupini izvanrednih pravnih lijekova. Riječ je o vrlo ograničenom i složenom institutu. Početak rada bavi se utvrđivanjem pojma, općih obilježja i pravno zaštitne funkcije ponavljanja. Objašnjavaju se odluke koje mogu biti predmetom pobijanja te pretpostavke koje je potrebno ispuniti kako bi se uopće mogao koristiti ovaj pravni lijek. U središnjem dijelu rada objašnjeni su razlozi zbog kojih je moguće tražiti ponavljanje postupka, rokovi unutar kojih je moguće podnijeti prijedlog za ponavljanje postupka, formalne pretpostavke prijedloga te struktura samog postupka povodom ponavljanja. Uz to su prikazani informativni statistički podaci o korištenju ovog pravnog lijeka u Republici Hrvatskoj prikupljeni od strane općinskih i trgovačkih sudova. Završni dio rada objašnjava odnos između izvanrednih pravnih lijekova - revizije i ponavljanja postupka te ponavljanje postupka povodom konačne presude Europskog suda za ljudska prava.
Abstract (english)
This thesis deals with the renewal of proceedings in Croatian civil procedure. Renewal of proceedings represents a special legal remedy that belongs to the group of extraordinary legal remedies. It's an about very strict and complex concept. The first section establishes terms, general features, and legal safeguards functions of renewal. It explains decisions that could be objects of rebuttal and assumptions which must be fulfilled if we want to use this legal remedy. The central part explains reasons that might be a legal basis for renewal of proceedings, legal deadlines to apply for renewal, formal assumptions of application, and the structure of the renewal procedure itself. After that, it shows informative statistical data about using this legal remedy in Croatia, collected by domestic courts. The last part explains the relation between extraordinary legal remedies – review, and renewal of proceedings and also using renewal of proceedings in response to the final judgment of the European Court of Human Rights.
