Abstract
Tematika ovog rada jest stranačka sposobnost entiteta koji nemaju pravnu osobnost. Posljedica toga jest da oni ne mogu biti stranka u postupku što znači da ne mogu stjecati nikakva prava i obveze. U ovom radu se osim problematike stranačke sposobnosti obrađuju primjeri tih entiteta, odnosno oblici udruživanja kojima zakonodavac ili sud unatoč nedostatku pravne osobnosti može dati mogućnost da sudjeluju u sporu kao stranka (daje im: ius standi in iudicio) te im na taj način omogućavaju zaštitu svojih ovlaštenja u parnici, i gdje su navedeni mnogobrojni primjeri iz sudske prakse koji tumače zakonske odredbe vezane za stranačku sposobnost onih kojima to pravni poredak ne priznaje. Zatim se parnični postupak uspoređuje sa upravnim sporom i konačno se analiziraju propisi drugih država koji propisuju navedeno.
Abstract (english)
The topic of this paper is the party capacity of entities that do not have legal personality. The consequence of this is that they cannot be a party to the proceedings, which means that they cannot acquire any rights and obligations. In addition to the issue of party capacity, this paper deals with examples of these entities, i.e. forms of association which, despite the lack of legal personality, the legislator or the court can give the opportunity to participate in a dispute as a party (gives them: ius standi in iudicio) and thus enable them to protect their authority in litigation, and where there are numerous examples from court practice that interpret legal provisions related to party capacity of those who are not recognized by the legal order. Then, the civil procedure is compared with the administrative dispute, and finally the regulations of other countries that prescribe the above are analyzed.
