Abstract
Cilj ovog rada jest okarakterizirati institut suparničarstva, razraditi pravne, odnosno zakonske pretpostavke potrebne za njegovo utemeljenje te teorijski i praktično opisati njegove vrste. S tim u vezi, razjasniti kako pojedina vrsta suparničarstva utječe na utvrđivanje stvarne i mjesne nadležnosti sudova, na procjenu vrijednosti spora i izračun troškova postupka kao i na pravne posljedice poduzetih radnji i odluke koje sudovi donose ovisno o vrsti suparničarstva u postupku. Rad također ima za cilj učiniti teorijsku analizu i praktične primjere relevantnijim za poteškoće koje sudska praksa ima kada odlučuje postoji li pitanje suparničarstva i, ako postoji, o kakvim se suparničarima radi.
Abstract (english)
The aim of this paper is to characterize the institute of multiparty litigation, to work out legal, more accurately, assumptions of law needed for its foundation and to describe its types theoretically and practically. Proceeding from that, to clarify how each type of multiparty litigation affects the determination of the actual and local jurisdiction of the courts, the assessment of the value of the dispute and the calculation of the costs of the procedure, as well as the legal consequences of the actions taken and the decisions made by the courts depending on the type of multiparty litigation in the procedure. The paper also aims to make the theoretical analysis and practical examples more relevant to the difficulties that jurisprudence has when deciding whether there is an issue of multiparty litigation and, if so, what kind.
