The subject of this master's thesis is immaterial damage caused by publication in media. At the very beginning, we give an analysis of immaterial damage through the Civil Obligations Act which is a constitutive legal act in the area of liability for damage in the Republic of Croatia. Immaterial damage is a violation of personality rights according to legal definition. Equalization of the terms immaterial damage and violation of personality rights was a significant change regarding the previous legal definition. Onwards analyzed the relation between the term of personality rights and freedom of media, respectively conflict between the two mentioned terms. The conflict occurs when the freedom of media exceeds the limits of its activity in such a way that causes a violation of personality rights. The middle part of this paper is dedicated to forms of repairing immaterial damage caused by publication in media through the provisions of the Media Act and Civil Obligations Act. In situations where the personality rights were violated by publication in media, the injured party has available legal means to repair the caused immaterial damage. The right to correct published information, the right to respond to published information, the publication of the judgment, and fair monetary compensation were analyzed. Each of the mentioned forms of repairing immaterial damage is followed by judicial practice, which shows how the prescribed forms of repairing immaterial damage are applied and with what success. There is a lot of jurisprudence, but many shortcomings have been observed, on the part of the injured party, who sometimes fail to understand their right due to an insufficiently well-argued request for correction of information, but cases of successful realization of the right to repair immaterial damage have also been singled out.
