Abstract
Ovaj završni rad istražuje ključne aspekte instituta izvlaštenja, s naglaskom na problematiku određivanja interesa Republike Hrvatske kao jedne od temeljnih pretpostavki za provedbu postupka izvlaštenja. Kroz rad se analiziraju povijesni razvoj instituta izvlaštenja, pozitivni propisi Republike Hrvatske koji reguliraju ovaj institut te se daje usporedni prikaz odgovarajuće pravne regulative u okviru normativnih sustava različitih država. Posebna pažnja posvećena je definiciji i tumačenju pojma „interes Republike Hrvatske“ u kontekstu izvlaštenja, s posebnim naglaskom na relevantnu sudsku praksu ga koja oblikuje i definira. U radu se nastoji dati sveobuhvatan uvid u kompleksnosti i važnost instituta izvlaštenja u suvremenom pravu te skrenuti pozornost na pojedina dvojbena pitanja vezana uz njegovu primjenu u praksi.
Abstract (english)
This paper explores the key aspects of the institute of expropriation, with an emphasis on the issue of determining the interest of the Republic of Croatia as one of the fundamental prerequisites for conducting the expropriation process. The paper analyzes the historical development of the institute of expropriation, the current regulations of the Republic of Croatia that govern this institute, and provides a comparative overview of the corresponding legal regulations within the normative systems of various countries. Special attention is given to the definition and interpretation of the term 'interest of the Republic of Croatia' in the context of expropriation, with a particular emphasis on relevant judicial practice that shapes and defines it. The paper aims to provide a comprehensive insight into the complexities and importance of the institute of expropriation in contemporary law and to highlight certain contentious issues related to its application in practice.
