Abstract (english)
The relationship between intellectual property law (IPL) and private international law (PIL) has been nothing short of a puzzling, dynamic and transformative journey for all stakeholders over many decades. Despite the disciplines’ inescapably similar acronyms, they have managed to escape each other’s paths and remain on separate sides of the legal spectrum for a long time. The blame lies primarily on the principle of territoriality, which traditionally derived from the conception that IPL embodies economic, social and cultural policies of an individual State, which sovereignly confers exclusive rights over these important intangible resources. As such, IPRs were thought to belong to the public law sphere and in any case beyond the reach of foreign States’ courts or laws. Influenced predominantly by the increasing cross-border exploitation and infringement of IPRs, the trend of reduction in the scope and rigorousness of the principle of territoriality appeared gradually. In the European Union, the turning point was the 1968 Brussels Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters, which resolved the debates concerning adjudicating foreign IPRs.
