Abstract
Predmet ovog završnog rada je biračko pravo i njegova pravna zaštita. Biračko pravo predstavlja subjektivno pravo građana odnosno državljana. Ono je temeljno političko pravo zajamčeno Ustavom, a detaljnije je uređeno izbornim zakonima. Glasanje u nekim zemljama predstavlja građansku dužnost, a ponegdje i građansku obvezu. Shvaćanjem glasanja kao obveze odnosno neizvršenja te obveze, osoba može snositi posljedice. Nadalje, glasanje predstavlja sredstvo za slobodno izražavanje građana. Njime se pokreće i formira proces građanske integracije. Izlaskom na izbore i glasanjem u pitanje se dovodi legitimacija političke vlasti. Može se reći kako je biračko pravo zapravo skup određenih političkih prava. Građani imaju mogućnost birati između mnogih političkih opcija i kandidata. Također, oni se mogu kandidati na izborima. Upravo su izbori sredstvo koje omogućuje da se postavljaju i rješavaju mnoga pitanja koja se odnose na društveno uređenje, gospodarstvo te zajedničke vrijednosti.
Abstract (english)
The subject of this final thesis is the right to vote and its legal protection. The right to vote is a subjective right of citizens. It is a fundamental political right guaranteed by the Constitution, and is regulated in more detail by election laws. Voting in some countries is a civic duty, and in some it is a civic obligation. By understanding voting as an obligation, or failing to fulfill that obligation, a person can bear the consequences. Furthermore, voting means free expression of citizens. It initiates and forms the process of civil integration. By going to the polls and voting, the legitimacy of the political authority is called into question. It can be said that voting rights are actually a set of certain political rights. Citizens have the opportunity to choose between many political options and candidates. Also, they can be candidates in elections. Elections are precisely the tool that enables many questions related to social order, economy and shared values to be raised and resolved.
