Abstract
Pravo osobnosti predstavlja jednu od novijih i složenijih kategorija unutar suvremenog građanskog prava. Unatoč složenosti, njegov građanskopravni karakter ostaje neupitan. Ključno je napomenuti da zaštita prava osobnosti mora biti u rukama osobe čije je pravo povrijeđeno, što predstavlja osnovu za tvrdnju kako se radi o subjektivnom građanskom pravu. Na europskoj i nacionalnoj razini, pravo osobnosti čini značajan dio građanskopravnog sustava, potvrđujući njegovu važnost u zaštiti temeljnih... More ljudskih prava. Složenost prava osobnosti stvara značajne izazove, posebno u kontekstu pravnih poslova koji se odnose na ovo pravo. U tom smislu, pravna doktrina mora biti oprezna kako bi se izbjegla promocija „egzotičnih” pravnih poslova koji služe samo u svrhu samopromocije autora, a ne doprinose zaštiti dostojanstva pojedinca, što je temeljna svrha prava osobnosti. Dugotrajan proces razvoja nauke o pravnim poslovima u okviru prava osobnosti od ključne je važnosti za pravilnu primjenu građanskog prava. Abstract (english)
The right to personality is one of the more recent and complex categories within modern civil law. Despite its complexity, its civil law nature remains unquestionable. It is essential to emphasize that the protection of the right to personality must rest in the hands of the individual whose right has been violated, which forms the basis for the assertion that this is a subjective civil right. On both the European and national levels, the right to personality constitutes a significant part... More of the civil law system, confirming its importance in the protection of fundamental human rights. The complexity of the right to personality presents significant challenges, particularly in the context of legal transactions related to this right. In this respect, legal doctrine must be cautious to avoid promoting "exotic" legal transactions that serve merely for the self-promotion of authors, rather than contributing to the protection of individual dignity, which is the fundamental purpose of the right to personality. The long-term development of the science of legal transactions within the framework of the right to personality is crucial for the proper application of civil law. This paper provides a detailed analysis of legal transactions concerning the right to personality, highlighting key issues and challenges arising from the legal regulation of this field. Less
