Abstract
Ovaj ću rad započeti kratkim pregledom razvoja prava zaštite potrošača kroz primarno i sekundarno zakonodavstvo EU, te kako je isto inkorporirano u pravni poredak RH. U nastavku slijedi poglavlje u kojem ću se baviti posebnim instrumentima zaštite potrošača, posebice predugovornim obavještavanjem koje prethodi jednostranom raskidu ugovora te alternativnim načinima rješavanja potrošačkih sporova. U sljedećem poglavlju ću se ukratko osvrnuti na sam institut jednostranog raskida kroz europske direktive i nacionalne propise koji uređuju taj institut, osobito Direktiva 2011/83/EU o pravima potrošača i Zakon o zaštiti potrošača, te ću obraditi problematiku terminologije predmetnog instituta osvrćući se na različita rješenja koja su preuzeta u europsko i nacionalno zakonodavstvo. Isto tako, u istom ću poglavlju razlučiti te razlikovati dva različita instituta, jednostrani raskid predviđen ZZPom te raskid ugovora uređen ZOO-om. U narednom poglavlju slijedi detaljna obrada instituta jednostranog raskida kroz određivanje rokova za jednostrani raskid ugovora, kada oni počinjui u kojem trenutku završavaju, te isto tako u kojem se slučaju oni mogu produljiti u korist potrošača. Osim toga vidjet ćemo i na koji način se pravo jednostranog raskida ostvaruje te koje su pravne posljedice korištenja istog, a između ostalog obradit ću i koje obveze proizlaze, kako za trgovca, tako i za potrošača, nakon što potrošač iskoristi svoje pravo jednostranog raskida ugovora. Poglavlje ću završiti prikazom situacija u kojima je pravo potrošača da jednostrano raskine ugovor isključeno. Prilikom objašnjavanja predmetnog instituta te pisanja ovog rada koristila sam relevantnu sudsku praksu kao i potrebnu stručnu literaturu te pravne propise.
Abstract (english)
I will start this academic research with short overwiev of the development of consumer protection rights through the primary and secundary EU legislation and its incorporation in the legal order of the Republic of Croatia. Further, there is a chapter about special consumer protection instruments, especially about precontractual informations which precedes the consumers right of withdrawal and about alternative ways of resolving the consumer disputes. In the next chapter I will shortly explain what institute of right of withdrawal is through the european directives and national legislation, especially Directive 2011/83/EU on consumer rights and Consumer Protection Act. Also I will try to explain the difference between the institute of the right of withrawal in ZZP and right of termination the contract in ZOO. In the last chapter I will write obout period in which consumer can withdraw from the contract, when this period begin and shall expire and what happens with this period in the case of omission of information on the right of withdrawal. Except of that, I will explain effects of withdrawal and obligations of the consumer and trader in the event of withdrawal. I will finish the last chapter with exceptions from the right of withdrawal. When explainig the right of withdrawal and writing this academic research, I used national and practice of law used in Court of Justice in the European Union and relevant scientific literature and european and national legislation.
