Abstract
Pravo zaštite potrošača regulira odnos između trgovca i potrošača. Zakon o zaštiti potrošača, kao lex specialis za zaštitu potrošača, osim što definira temeljne pojmove tog pravnog područja, utvrđuje prava i obveze obiju strana potrošačkog odnosa. Kao središnji dio Zakona o zaštiti potrošača možemo odrediti dijelove koji se odnose na instrumente putem kojih potrošači mogu ostvariti svoja prava. U ovom radu, osim detaljnijeg određenja pojmova „potrošač“ i „trgovac“ dan je pregled svih postojećih sredstava zaštite potrošača. Iako možemo reći da je pravni sustav Republike Hrvatske glede zaštite potrošača usklađen s pravom Europske unije, potrebno je poduzeti određene korake radi poboljšanja provedbe spomenutih pravnih pravila, a time i vraćanje povjerenja potrošača u odnosu na institucije čija djelatnost se sastoji u provođenju pravnih propisa.
Abstract (english)
The law of consumer protection regulates the relationship between the trader and the consumer. The Consumer Protection Act such as the lex specialis for consumer protection, in addition to defining the fundamental concepts of this legal area, establishes the rights and obligations of both parties to the consumer relationship. As a central part of the Consumer Protection Act, we can identify parts that relate to instruments through which consumers can realize their rights. In this paper, except more detailed definitions of the terms "consumer" and "trader", a review of all consumer protection means is given. Although we can say that the legal system of the Republic of Croatia in terms of consumer protection is compatible with European Union law, it is necessary to take certain steps to improve the enforcement of mentioned legal rules, and thus to restore consumer confidence in relation to institution whose activity consists in the enforcement of legal regulations.
