Abstract
Cilj ovog diplomskog rada bio je analizirati na koji je način uređena zaštita prava trudnica na tržištu rada u hrvatskom zakonodavstvu. Na samome početku razmotriti će se pravni izvori zaštite majčinstva, hrvatskog, međunarodnog i europskog zakonodavstva. Zatim će se dati definicije trudnice, radnice koja je rodila i radnice koja doji prema Zakonu o rodiljnim i roditeljskim potporama. Dok će se u trećem dijelu ukratko opisati povijesni razvoj prava žena u Europi i Hrvatskoj. Najvažniji dio ovog... More rada je „Zaštita majčinstva“ budući da su u tom dijelu detaljno opisana sva prava koja žene imaju za vrijeme trudnoće, poroda i pri povratku na posao. Veliki problem s kojim se trudnice susreću na tržištu rada je diskriminacija istih prilikom zapošljavanja, kao i na samom radnom mjestu. U radu se opisuje problematika spolne diskriminacije te se daje uvid u stanje na Hrvatskom tržištu rada. U posljednjem dijelu analizira se sudska praksa ukupno tri suda, Ustavnog suda Republike Hrvatske, Vrhovnog suda Republike Hrvatske te Europskog suda u Luksemburgu. Less
Abstract (english)
The purpose of this thesis paper is to analyze in which method are organized protection of the rights of pregnant women on labor market in Croatian legislation. At the beginning will be considered legal sources protection of motherhood, Croatian, international and European legislation. Then will be given definitions of pregnant women, worker who gave birth and worker who is breastfeeding according to Zakon o rodiljnim i roditeljskim potporama. While the third part briefly describes the... More historical development women`s rights in Europe and Croatian. The most important part of this work is „Protection of motherhood“ since this part describeds in detail all the rights that women have during pregnancy, childbirth and in returning to work. A major problem that pregnant women face in the labor market is discrimination in employment, and at the work place. The paper describes the problems of sex discrimination and gives insight in the state of the Croatian labor. And the final section analyzes the case law of three courts, Croatian Constitutional Court, Croatian Supreme Court and European Court in Luxembourg. Less
