Abstract
U ovom je diplomskom radu iznesen sustav izvanrednih pravnih lijekova koji se primjenjuju na pravomoćne odluke donesene u kaznenim postupcima prema zakonodavstvu Republike Hrvatske. U uvodnom dijelu iznesena je općenita definicija pravnih lijekova, njihova općenita podjela, čemu služe te kako se i u kojim situacijma mogu primjeniti. U nastavku rada detaljnije su analizirani izvanredni pravni lijekovi u kaznenom postupku. Od obnove kaznenog postupka, preko zahtjeva za zaštitu zakonitosti pa do zahtjeva za izvanredno presipitivanje pravomoćne presude. Uz općenite karakteristike svakog pojedinog pravnog lijeka, analiziran je zakon, ali i neke presude Vrhovnog suda Republike Hrvatske, koje pomažu da se na jednostavniji način shvati važnost i učinkovitost primjene izvanrednih pravnih lijekova.
Abstract (english)
This work is about extraordinary legal remedies in criminal proceedings. In the beginning of this paper is explained what legal remedies are in general, who can use them, how and when. Extraordinary legal remedies are the main subject of this paper, so through the paper is explained everything about them. Extraordinary legal remedies can challenge a final court decision only in a specific situation and specific circumstances that are defined by the Law. It is allowed when no other method is available, appropriate or useful. In Croatian legislation, there are three extraordinary legal remedies, but the right to an effective legal remedy is guaranteed by domestic and by the international law. This paper explains extraordinary legal remedies in detail and with practical analysis and analysis of law in Croatia helps understand the importance and effectiveness of the use of certain legal remedy in criminal proceedings.
