Abstract
U ovome diplomskom radu obrađuje se tema očevida na mjestu događaja. Svrha očevida je utvrditi i spoznati relevantne činjenice, dati njihovo uzročno-posljedično objašnjenje i povezati ih s ostalim dokazima u cilju utvrđivanja istine o onome što se dogodilo. Propisi kaznenog postupovnog prava uređuju pravnu osnovu za poduzimanje očevida, ali očevidna djelatnost je po svom sadržaju kriminalističkog karaktera. Na početku rada će biti izloženi temeljni pojmovi, načela i ciljevi očevidnog... More postupanja. U središnjem dijelu rada naglasak će biti na pojašnjenju mjesta očevida kao objekta opažanja i spoznaje, načinu pristupa tom prostoru i postupanju očevidne ekipe na mjestu događaja. Nakon navedenog slijedi detaljnije pojašnjenje stadija očevida, taktičko-tehničkih pravila postupanja na mjestu očevida te načina fiksiranja utvrđenog činjeničnog stanja. Zaključno, slijedit će prikaz najčešćih propusta u praksi obavljanja očevida kako bi se upozorilo na ključne čimbenike na koje očevidno tijelo treba obratiti pozornost u svom radu. Abstract (english)
This thesis deals with the topic of crime scene investigation. The purpose of the CSI is to comprehend and determine the possible relevant evidence, to provide their causal and consequential explanation, and to relate them to other evidence in order to establish the truth of what happened. The regulations of criminal procedural law provide the legal basis for undertaking the CSI, but the process of its procedure is criminal in nature. At the beginning of the thesis the basic... More concepts, principles and goals of the CSI procedure will be presented. In the main part of the thesis, the emphasis will be on explaining the CSI location as an object of observation and cognition, how to access that space and the behavior of the CSI team at the scene. This is followed by a more detailed explanation of the CSI stages, the tactical and technical rules of CSI procedure at the scene and the method of the established factual situation recording. Finally, an overview of the most common omissions in CSI practice will be presented in order to highlight the key factors that the CSI team in their work should be aware and pay attention to. At the end of the thesis are briefly explained the reconstruction and experiment and their role in relation to the CSI. Less
