Abstract
Ovaj diplomski rad prikazuje obiteljsko nasilje u praksi Europskog suda za ljudska prava u Strasbourgu. U tu svrhu prati razvoj ljudskih prava s naglaskom na prava žena i djece koji su najčešće žrtve obiteljskog nasilja i razvoj relevantnih međunarodnih instrumenata zaštite, fokusirajući se na praksu Europskog suda za ljudska prava u kojima je isti prepoznao kršenja prava zaštićenih Europskom konvencijom za zaštitu ljudskih prava i temeljnih sloboda, posebice prava na život, zabrane mučenja i nečovječnog ili ponižavajućeg postupanja ili kažnjavanja i prava na poštovanje privatnog i obiteljskog života. U radu je razmatran i hrvatski zakonodavni okvir te utjecaj Konvencije o sprječavanju i borbi protiv nasilja nad ženama i nasilja u obitelji (Istanbulska konvencija) na promjene hrvatskog zakonodavstva prije i poslije njezine ratifikacije.
Abstract (english)
This thesis analyses the issue of domestic violence in the practice of the European Court of Human Rights in Strasbourg. For this purpose, it looks at the development of human rights protection with a focus on the rights of women and children who are most likely to be the victims of domestic violence together with the development of relevant international instruments of protection. Main focus of the thesis is on the judgments of the European Court of Human Rights where it found violations of the rights protected under the European Convention for the Protection of Human Rights and Fundamental Freedoms, in particular the right to life, the prohibition of torture and inhuman or degrading treatment or punishment, and the right to respect for private and family life. The thesis also discusses the Croatian legislative framework and the impact of the Convention on Preventing and Combating Violence against Women and Domestic Violence (Istanbul Convention) on the amendments in the Croatian legislation before and after its ratification.
