Abstract
Tema ovog rada je „Ograničenje ljudskih prava i sloboda u izvanrednim stanjima s posebnim naglaskom na pandemiju Covid-19“, a cilj je prikazati sljedeće. Ljudska prava i temeljne slobode smatraju se najvišim vrednotama ustavotvornog poretka, kako svjetskih tako i nacionalnih ustava. Zbog toga je prvobitno opisan sam pojam ljudskih prava te sve bitne pretpostavke koje on obuhvaća. Nadalje, bitno je spomenuti i ograničenja koja dovode do smanjenja potpune slobode svakoga čovjeka te opravdanost za tim ograničenjima. Nakon pojašnjenja pojma ljudskih prava i ograničenja istih, detaljno je opisano izvanredno stanje koje se javlja kao poseban dio ograničenja temeljnih sloboda. Na kraju rada je prikazano izvanredno stanje u doba pandemije Covid-19, kao pojava koja je dovela do reguliranja i prilagođavanja raznih zakonskih propisa. Takva je pojava uzrokovala bitne promjene u pogledu ustavnih vrednota i ograničenja sloboda.
Abstract (english)
The topic of this paper is "Restriction of human rights and freedoms in emergencies with special emphasis on the Coved pandemic19", and the goal is presented below. Human rights and fundamental freedoms are considered the highest values of the constitutional order of both world and national constitutions. Therefore, the very concept of human rights was originally described as the importance of their regulations, which should be emphasized in view of the time period and certain novelties in the legal order. Furthermore, it is important to mention their limitations, which leads to a reduction in the complete freedoms of every human being, but on the other hand, the justification for the time limit in order to establish the rule of law. After human rights and their restrictions, the notion of state of emergency is described in detail, which appears as a special part of the restriction of fundamental freedoms. At the end of the paper, the state of emergency at the time of the Coved 19 pandemic is presented as a phenomenon that led to the regulation and adjustment of various legal regulations that caused significant changes in terms of constitutional evaluations and restrictions on freedom.
