Abstract
Pretplatnički ugovori su jedna od vrste ugovora u kojima je očita neravnoteža između ugovornih strana. Nepoštene ugovorne odredbe jedna su od posljedica te neravnoteže. U ovom radu dan je pregled instituta nepoštenih ugovornih odredbi u pretplatničkim ugovorima u hrvatskom pravu. U prvom dijelu rada obrađeno je uređenje nepoštenih ugovornih odredbi, uređenje pretplatničkog ugovora te korištenje nepoštenih odredaba u pretplatničkim ugovorima. U drugom dijelu analizirano je uređenje nepoštenih ugovornih odredbi u pretplatničkim ugovorima u hrvatskom pravu. Na kraju rada je dan pregled zaštite pretplatnika i sudske prakse u RH.
Abstract (english)
Subscription contracts are one of the types of contracts in which there is apparent imbalance between parties of the contract. Unfair contract terms are one of the repercussions of this imbalance. This paper gives an overview of the institute of unfair contract terms in the subscription contracts in Croatian law. The first part deals with the regulation of unfair contractual provisions, regulation of the subscrription contracts and the use of unfair terms in subscription contracts. The second part analyzes the regulation of unfair contract terms in the subscription contracts in Croatian law. Finally, this paper ends withe the review of procedural protection of subscribers and judicial practice in the Republic of Croatia.
