Abstract U ovom radu obrađuje se tema prava građenja u praksi, na primjeru grada Rijeke. Radi se o institutu koji je definiran Zakonom o vlasništvu i drugim stvarnim pravima. Osim pojmovnog određenja navedenim zakonom se uređuju pitanja sadržaja prava građenja, stjecanja prava građenja, zaštita istog te njegov prestanak kao i posljedice prestanka. Navode se i osobe nositelja prava građenja i osnivača prava građenja. Kroz rad su prikazani brojni primjeri u kojima se u ulozi osnivača nalazi upravo Grad Rijeka, koji u svom vlasništvu ima površinom velika zemljišta, pogodna za osnivanje ovog instituta.
Nadalje, u radu je prikazana definicija prava građenja kao „ograničeno stvarno pravo na nečijem zemljištu koje ovlašćuje svog nositelja da na površini tog zemljišta ili ispod njega ima vlastitu zgradu“. Objašnjavajući sadržaj predmetnog instituta pozornost je dana i primjeru Rijeka Promet d.o.o. Nezaobilazne teme bile su i funkcije prava građenja, a izgradnja stambenih objekata isključivo sa socijalnom svrhom odigrala je važnu ulogu u 21. stoljeću.
Dalje se kazuje detaljnije o predmetu prava građenja, te je dan zanimljiv primjer s podzemnom garažom Stari grad koja se nalazi na zemljištu u vlasništvu Grada Rijeke. Definirano je zemljište ali su dotaknuti i slučajevi izgradnje pod površinom zemlje, kao i na površini zemljišta. Nadalje, o stjecanju prava građenja je istaknuto sve sukladno ZV-u. Tema se dalje raščlanila obradom titulusa kao i modusa stjecanja. Navedeno je potkrijepljeno praktičnim primjerom ex Rikard Benčić koji do današnjih dana nije ni u začetku realizacije, a također je tu i ugovor između Grada Rijeke i Hrvatske Elektroprivrede te primjer sa Sveučilištem Rijeka.
Na koncu je rečeno nešto o temi prestanka i posljedicama prestanka prava građenja. Do prestanka u praksi nerijetko dolazi, jer su subjekti u nezavidnom položaju kada moraju snositi visoke naknade za osnovano pravo građenja, a to nisu u mogućnosti. Danas kada je financijsko stanje sve teže, nositelji prava građenja ne ispunjavaju ugovorne obveze, te nužno dolazi do raskida ugovora a projekti bivaju nerealizirani što nam dokazuje i navedeni primjer stadiona Kantrida i kampa Rujevica.
Abstract (english) In this project, the subject of building lease is being discussed as seen on the example of the City of Rijeka. It is an institution defined by the Law of ownership and other legal matters. Apart from the conceptual definitions, this law also arranges the content of the building rights, acquiring building rights, its conservation, termination and its consequences. Persons who bear the building lease and set it up are mentioned in this elaboration as well. Through this work, there are numerous examples in which the role of the founder holds the City of Rijeka itself. Rijeka owns land of great proportions suitable for establishing this institute.
Furthermore, this project shows the definition of building lease as “a limited law of real property on somebody's land which entitles its owner to own a building on the area of that land or beneath it. While explaining the content of the institute in question, the example of Rijeka Promet Ltd was taken into attention. Inevitable subjects were the functions of the building rights, and the building of the residential facilities for strictly social purposes which played a main role in the 21st century.
To continue with, there is a detailed look into the building rights with an interesting example of an underground garage “Stari grad” which is located on the property owned by the City of Rijeka. The land property has been defined and there are cases of building under ground as well as on the surface. About acquiring building permits, all facts according to the are pointed out. The subject has further been divided by covering the topic of titulus and modus way of acquiring rights. To show how that works, there is a practical example of the former Rikard Benčić which to this day hasn't been carried out, and the examples of the contract between the City of Rijeka and the Croatian Electrical Company “HEP” and the example of the University of Rijeka.
To sum up, the subject of building termination and its consequences were mentioned. Termination often happens in practice due to the high fees which come up while trying to establish the building lease, which then cannot be paid for. Nowadays, when the financial situation is getting worse and worse, the bearers of the building lease do not fulfil their legal contract duties and therefore termination is bound the happen and the projects finish unrealized, which is shown on the example of the Kantrida stadium and camp Rujevica.
