Abstract
Tema ovog diplomskog rada je institut odgovornosti države za štetu prouzročenu osobama privatnog prava povredom pravila Europske unije. U radu se kroz povijesni pregled nastanka načela odgovornosti promatraju pravni temelji za njegovu uspostavu i razvoj instituta kroz praksu Suda EU-a. Kroz najistaknutije presude Suda EU-a rad obrađuje pretpostavke koje moraju biti zadovoljene kako bi se utvrdila odgovornost države za štetu prouzročenu pojedincu. To su povrijeđeno subjektivno pravo... More pojedinca, dovoljno ozbiljna priroda povrede, te uzročna veza između povrijeđene norme i nastale štete. Konačno, rad pokušava definirati vrste povrede koju država može počiniti činjenjem ili propuštanjem, te promatra različita tijela državne vlasti u ulozi štetnika. Obrađeni su i načini na koje zakonodavna, izvršna i sudska vlast mogu povrijediti pojedincima tzv. „europska“ prava, te kakav je stav Sud EU-a o tome zauzeo. Na posljetku rad se osvrće i na zahtjev za naknadu štete u državama članicama naglašavajući pritom poteškoće i probleme provođenja ovog instituta u praksi pred nacionalnim sudovima. Less
Abstract (english)
The topic of this graduation paper is the institute of state liability for damage caused to private individuals for the breach of EU law. This paper demonstrates historical origins of institute, legal basis for its establishment and its development through the case law of the Court of Justice of the European Union (CJEU). Analysing prominent CJEU judgments, the paper deals with conditions that must be met in order to establish state liability for damage caused to private persons.... More That being: conferred rights to individuals, sufficiently serious breach, and direct causal link between the breach committed by the Member State and the resulting damage. Finally, the paper attempts to define the sorts of states violations in form of doing and omitting and analysis different state authorities in the role of the injurer. It elaborates manners in which legislative, executive and judicial bodies can violate the so-called “European” rights and the standing of the CJEU. The paper concludes with the realization of claims for damages in the Member States and emphasizes difficulties and issues in enforcement of this institute before national courts. Less
