Abstract
U ovome je radu izložena tematika pravnog položaja lobista, polazeći od same definicije lobiranja i lobista te razgraničenje tog pojma od njemu srodnih pojmova, a daje se i općenit prikaz osnovnih vrsta i značajki lobiranja. Detaljno se analizira lobiranje u Sjedinjenim Američkim Državama od samih začetaka toga pojma do regulacije kakva postoji danas. Regulacija lobiranja u Europi prikazuje se kroz prizmu dviju najvećih i najznačajnijih međunarodnih organizacija toga teritorija – riječ je o Vijeću Europe i Europskoj uniji, a prikazano je i postojanje, odnosno nepostojanje propisa, registra transparentnosti i etičkog kodeksa u državama članicama Europske unije. I, u konačnici, prikazano je kako izgleda regulacija lobiranja u Republici Hrvatskoj u kontekstu nepostojanja zakonskog propisa koji bi regulirano dotično te su iznesena zaključna razmatranja.
Abstract (english)
This Master’s thesis with the subject of the legal status of the lobbyists, starting with the definition of lobbyist and lobbying, and delimiting the term from related ones, as well as giving a general overview of the basic types and features of lobbying. Lobbying in the United States has been thoroughly analyzed – from the very beginnings of this term to regulation as it is today. The regulation of lobbying in Europe is presented through the prism of the two largest and most significant international organizations on this territory – the Council of Europe and the European Union. Moreover, it shows the existence or absence of regulations, transparency registers and ethics codes in the EU member states. Finally, the regulation of lobbying in the Republic of Croatia is presented in the context of non-existence of a statutory regulation that would regulate lobbying. To conclude, final considerations were presented.
