Abstract
Zaštitu potrošača i radnika u prekograničnim ugovornim odnosima osigurava zaštitni režim sadržan u Uredbi (EZ) 593/2008 (Uredba Rim I), krovnom izvoru europskog međunarodnog privatnog prava glede ugovornih odnosa. Zaštitni režim u bitnom jamči da izbor mjerodavnog prava ne liši slabiju ugovornu stranku zaštite koju bi joj pružalo pravo koje bi bilo primjenjivo u odsustvu izbora. Ovaj rad započinje pregledom razloga i normativnih rješenja za zaštitu slabije ugovorne stranke u europskom međunarodnom privatnom pravu, uz poseban osvrt na ustavnopravne i ekonomske argumente. Zatim zaranja u strukturu Uredbe Rim I glede potrošačkih i pojedinačnih ugovora o radu, ocrtavajući osnovne mehanizme zaštite. Naposljetku, nudi se ekonomska analiza zaštitnog režima, njegov utjecaj na pitanja regulacije te pregled problema koji nastaju u njegovoj praktičnoj primjeni.
Abstract (english)
The protection of consumers and employees in cross-border contractual relations is governed by the protective regime contained in Regulation (EC) 593/2008 (Rome I Regulation), which is the main source of European private international law regarding contractual obligations. The essence of the protective regime is to ensure that a choice of law clause does not deprive the weaker party to a contract of the protection afforded to him by the law that would have been applicable in the absence of choice. This thesis begins by providing an overview of the justifications and normative solutions for weaker party protection in European private international law, with special attention given to constitutional and economic arguments in its favour. It then delves into the architecture of the Rome I Regulation concerning consumer and individual employment contracts, outlining its basic mechanisms. Finally, it offers an economic analysis of the protective regime, its regulatory impact and the problems that occur in its practical application.
