The thesis elaborates the matter of the application of remote monitoring technology as an alternative measure to ensure the presence of the defendant in criminal proceeding but also as an stand alone punishment. It enables police (executive) and judical authority to carry out, impose, limit and supervise the spatial and temporal activities of defendants or convicts. Sophisticated tracking technology is used to monitor the execution of imposed measures or sanctions by monitoring the location, whereat recording presence of the person or its movement in addition to determining perimeters of permitted or prohibited geographical zones. Modern technological development has enabled the effective application of the institute of pretrial home detention using remote control measures as a substitute for imprisonment in jails or penitentiaries. The paper provides a comparative overview of this punitive measure at the United States of America and Western European Countries. The Croatian legislative framework and Supreme Court case-law analysis of pretrial home detention are also portrayed. Technical, ethical and legal issues related to the development and application of measure on the institute mentioned were analyzed in detail. This tool is especially applicable to individuals awaiting trial, i.e., those who have not been convicted and for whom there is a possibility that they will not be found guilty of the offense charged.
