Abstract
Tema ovog diplomskog rada je kolektivni višak radnika. Kroz ovu temu i diplomski rad objašnjava se pojam kolektivnog viška radnika, obratit će se pozornost na probleme koje nosi ta tematika te će biti temeljito obrađeni. Postoje objektivna i subjektivna obilježja kolektivnog otkazivanja, te će njihove razlike biti objašnjene. Spominjat će se i navesti razlozi za poslovno uvjetovani otkaz. Proučiti će se i napisati kada se počelo razvijati europsko pravo o kolektivnim viškovima radnika. Nadalje,... More navest će se što poslodavac mora učiniti u slučaju kolektivnog viška radnika, odnosno koje su njegove obveze spram radnika kojima će otkazati ugovore o radu, ali također koje su obveze radnika spram poslodavca. Navest će se i koje su pretpostavke otkaza zbog kolektivnog viška radnika, što kada otkaz nije na strani radnika? Objasnit će se uloga radničkog vijeća te kakvo značenje ono ima u cijelom postupku otkazivanja ugovora o radu, kad postoji obveza savjetovanja s radničkim vijećem, koji je njegov sadržaj te ishodi istog. Obratiti će se pozornost na mjere koje mogu poduzimati nadležna tijela javne vlasti i koji bi bili učinci tih mjera. Što bi se moglo učiniti u cilju smanjenja rizika nezaposlenosti te koji su mogući načini zbrinjavanja viška radnika te koji je značaj produktivnog zbrinjavanja viška radnika. Abstract (english)
Topic of this thesis ( diploma work) is collective dismissal. Throughout this topic and thesis the term collective dismissal will be explained and the focus on the issues connected with the mentioned topic will be given and elaborated in detail. Diferences between objective and subjective collective dismissal will also be elaborated. Work-conditioned dissmisal will also be mentioned along with the causes for such dissmisal. European law concearning collective redundancy of employees and its... More development will be elaborated. Furthermore, what employer is ought to do in situations concearning collective redundancy of employees along with his obligations towards employees whose work contracts he plans to dissmis and obligations that such employees have towards the employer will also be discussed. Conditions under which a dissmisal, due to the collective redundancy of employees, can be given will also be pointed out with an emphasize on the situation when the dissmisal is happening without of the employees fault. The role and significance of the works council in the whole process of work contracts dissmisal, along with cases in which an obligatory consultation with works councile is imposed, will be explained as well as the content and final outcome of such process. Attention will be given to the measures which competent public authorities may undertake and to their effects. What can be done with the aim to reduce the risk of unemployment, what are the possible ways of disposal of surplus workers and what is the significance of an effective disposal are only few questions that will be answered.
