Abstract
U radu su se detaljno analizirala prava i obveze ugovaratelja osiguranja kod ugovora o osiguranju imovine. Objašnjeno je na koji način ugovaratelj osiguranja mora prijaviti sve okolnosti koje su bitne osiguratelju za procjenu rizika osiguranja te koje su posljedice ako to ne učini na pravi način. Navedene su i opisane dužnosti plaćanja premije koje ugovaratelj osiguranja plaća osiguratelju te dužnosti osiguratelja na isplatu osigurnine osiguraniku. Definiran je interes i svrha osiguranja te sve vrste šteta koje se mogu ugovoriti. Analiziran je pravni položaj ugovaratelja osiguranja kod instituta nadosiguranja, višestrukog i dvostrukog osiguranja, suosiguranja te instituta podosiguranja. Opisano je tko će imati prava iz osiguranja u slučaja otuđenja osiguranog predmeta i kakva će prava prema trećima imati osiguratelj nakon što isplati naknadu ugovaratelju osiguranja ili osiguraniku.
Abstract (english)
The final paper analyzed in detail the rights and obligations of the policyholder in property insurance contracts. It is explained how the policyholder must report all the circumstances that are important to the insurer for assessing the insurance risk and what the consequences are if he does not do so in the right way. The obligations to pay the premium that the policyholder pays to the insurer and the obligations of the insurer to pay the insurance premium to the insured are listed and described. The interest and purpose of insurance and all types of damages that can be contracted are defined. The legal position of the policyholder at the institute of additional insurance, multiple and double insurance, co-insurance and sub-insurance institute was analyzed. It is described who will have insurance rights in case of alienation of the insured object and what rights the insurer will have against third parties after paying compensation to the policyholder or the insured.
