Abstract
Svrha ovog završnog rada je opisati uređenje korištenja jezika i pisma pred sudom. Prvi dio rada odnosi se na odredbe o jeziku u propisima na snazi u Republici Hrvatskoj uključujući i kratki osvrt na propise u Europskoj uniji, te na uporabu jezika i pisma nacionalnih manjina u Hrvatskoj. Drugi dio rada je osvrt na propise o uporabi jezika i pisma u okviru upravnog, kaznenog, prekršajnog i građanskog postupka pred hrvatskim tijelima. Treći dio rada podrobno razrađuje institut stalnih sudskih tumača koji imaju ključnu ulogu u pravosudnom sustavu omogućavajući komunikaciju i razumijevanje između stranaka koje ne govore jezik na kojem se vodi postupak. Teme koje su obrađene uključuju utvrđivanje ispunjenja uvjeta za imenovanje, pravima i dužnostima sudskih tumača, te razrješenje i zabrana obavljanja djelatnosti.
Abstract (english)
The purpose of this final paper is to describe the regulation regarding use of language and script before the court. The first part of the paper addresses the provisions on language in the laws and regulations in force in the Republic of Croatia, including the European Union legislation, and the use of languages and scripts of national minorities in Croatia. The second part of the paper provides a brief overview of the provisions on the use of language and script in the framework of administrative, criminal, misdemeanour and civil procedures before Croatian authorities. The third part of the paper elaborates in detail on the institute of court interpreters. They play a key role in the judicial system by facilitating communication and understanding between parties who do not speak the language in which the proceedings are conducted. Topics covered include the conditions for appointment, the interpreters’ rights and duties, as well as their dismissal and prohibition from performing their role.
