Child as a legal subject has special human rights which are typical and characteristic only to him. Children's rights, especially those realized in the family are very important for their development because the family for them represents the most important environment. This paper shows the development of children's rights in the family through the most important international and European documents, describes constitutional protection of children's rights and analyzes personal rights of the child in Croatian family law with a focus on the child's right to live with his parents. The right to care for life and health, the right to security and education, the right to live with their parents and the exercise of personal relationships with their parents and loved ones, the right to choose education, the child's right to express opinions, the right to institute proceedings and the child's consent to medical procedures are analyzed primarily through the provision of the Croatian Family Act which regulates the said rights and duties of parents in order to achieve and protect the right of the child, but also trough the Convention on the rights of the child.
