Abstract
Pomorsko dobro je opće dobro i, s obzirom na njegov status, jedinu mogućnost njegova gospodarskog iskorištavanja predstavlja koncesija. Luke nautičkog turizma nalaze se na području pomorskog dobra te predstavljaju prostor na kojem se pruža njihova glavna djelatnost, usluga veza, te sporedne djelatnosti poput ugostiteljstva, servisa, i slično. U radu su analizirani pravni odnosi između koncesionara luka nautičkog turizma, subjekata koji obavljaju sporedne djelatnosti na prostoru luka nautičkog turizma i korisnika luka nautičkog turizma. Institut potkoncesije, kao i ugovor o povjeravanju obavljanja sporednih djelatnosti i ugovor/sporazum o suradnji, koji služe kao pravni temelj obavljanja sporednih djelatnosti, te ugovor o vezu, koji služi kao osnova pružanja usluge veza, objašnjeni su kroz praksu i interne akte hrvatskih marina. Nužnost detaljnijeg pravnog reguliranja i definiranja prava i obveza iz tih odnosa spoznata je i od strane zakonodavca te uskoro slijedi donošenje Zakona o izmjenama i dopunama Pomorskog zakonika koji će sadržavati odredbe primjenjive i na te odnose.
Abstract (english)
Maritime domain is a common good, and due to its status, the only possibility of its economic exploitation is a concession. The ports of nautical tourism are situated in the maritime domain and represent the area where their main activity, i.e., berth service, and ancillary activities, like hospitality and repairs, are provided. Hence, this paper analyses the legal relations between the concessionaires of nautical tourism ports, the entities who perform ancillary activities in nautical tourism ports, and the users of nautical tourism ports. Sub-concession institute, the ancillary service procurement contract and the cooperation contract/agreement, serving as a legal basis for performing ancillary services, and the contract on berth usage, a basis of providing berth services, are explained through the practice and internal acts of Croatian marinas. The necessity of more detailed regulations and comprehensive definition of rights and obligations of the relations in question has been recognized by the legislator as well. Thus, the Act on Amendments to the Maritime Code, containing directives applicable to these relations, will soon be adopted.
