Abstract
Diplomski rad bavi se analizom imovinskopravnih posljedica nastalih između bračnih drugova prilikom razvoda braka. U prvom poglavlju dan je kratak povijesnopravni prikaz razvoja imovinskih odnosa bračnih drugova od razdoblja Rimskog carstva do donošenja Osnovnog zakona o braku 1946. godine koji je uveo dvije kategorije imovine bračnih drugova: posebnu/vlastitu i zajedničku. Pravna rješenja sadržana u Osnovnom zakonu o braku zadržana su, uz određene izmjene, u kasnijem Zakonu o braku i... More porodičnim odnosima. U razdoblju primjene navedena dva propisa stvorena je bogata sudska praksa kao dobra podloga boljem razumijevanju današnjeg imovinskopravnog režima uređenog Obiteljskim zakonom. Sukladno navedenom, u sljedeća dva poglavlja detaljno se, analizom odredbi Obiteljskog zakona i sudske prakse, razrađuju zakonsko te manjim dijelom ugovorno uređenje imovinskih odnosa bračnih drugova za vrijeme trajanja braka i prilikom njegova prestanka. Pri samom kraju diplomskog rada, osvrnuti ćemo se i na druga dva oblika obiteljskopravne zajednice u Republici Hrvatskoj, odnosno na izvanbračnu i istospolnu zajednicu i njihov položaj u pogledu imovinskih odnosa u odnosu na brak i bračne drugove. Abstract (english)
This M.A. thesis deals with the analysis of patrimonial consequences arising between spouses during the divorce process. The first chapter provides a short historical and legal depiction of the development of spousal property rights relations from the Roman Empire era to the passing of the 1946 Basic act of Marriage, which introduced two categories of marital property: own and collective asset. Legal solutions presented in the Basic act of marriage are maintained, with certain... More modifications, in a subsequent Act on marriage and family relations. During the period of application of the two previously stated regulations, a substantial case-law was created as a base for better understanding of today's patrimonial regime influenced by the Family law. As a continuation of that, the following two chapters contain a detailed, performed by an analysis of Family law provisions and case-law, elaboration on the statutory and slightly less on the contractual arrangement of property relations of spouses during marriage and upon its termination. Nearing the end of the thesis, a reflection on the other two forms of a legal union in the Republic of Croatia will be made. This includes domestic and same-sex partnerships and their position in terms of property relations in comparison to marriage and spouses. Less
