Abstract
Cilj je ovog rada prikazati pravno uređenje dužnosti informiranja potrošača prilikom sklapanja online ugovora o kupoprodaji ili ugovora o pružanju usluga s trgovcima, kao oblika ugovora sklopljenih na daljinu putem interneta. U radu se analiziraju pojam potrošača i pojam trgovca, kao subjekata potrošačkog (B2C) odnosa. Kako bi se umanjila neravnoteža u odnosu između potrošača i trgovca, potrošaču je potrebno pružiti što je više moguće informacija. Informiranjem potrošač spoznaje svoja prava i obveze u potrošačkom odnosu te osnovne karakteristike robe ili usluge, koju razmatra kupiti online, a što mu omogućuje donošenje informirane odluke. U radu je prikazan temeljni pravni okvir koji uređuje predugovorne i ugovorne informacije koje je trgovac dužan pružiti potrošaču u online okruženju, uz prikaz daljnjeg razvoja de lege ferenda dužnosti informiranja na razini EU-a.
Abstract (english)
The purpose of this paper is to give an overview of the legal arrangement of the duty to inform consumers when concluding an online purchase contract or service contract with traders, as a form of distance contracts concluded on the Internet. This paper analyzes the concepts of the consumer and the trader, as subjects of the B2C relationship. In order to reduce the imbalance in relations between consumers and traders, it is necessary to provide to the consumer as much information as possible. By informing consumers, he or she understands his rights and obligations in the B2C relationship and the basic characteristics of the goods or services he considers buying online, enabling him to make an informed decision. This paper presents the basic legal framework that regulates the pre-contractual and contractual information provided by the traders in an online environment, with a view of further developing of the de lege ferenda duty to inform at the EU level.
