Inviolability of home and the right of home protection as constitucional-convection law requires rigorous and exhaustive regulation of home search as one of the evidentiary actions envisaged in the croatian criminal precedures. The aim of this graduation thesis is to envisgate closely changes in the provision governing in which regulated implementation of these evidence activity from 1997. were based on, when search was one of the investigatory actions used during the criminal preceedings until the year od 2017 when the last chandes and amendments according to the criminal law preceedings act were executed. According to the fact of the strict regulation in home searxg implementation, failure to comply with some of the provisions may result in the illegality of the evidence collected by the evidentiary action which will ultimately result in the grounds for challenging the decisions rendered on the basis of such evidence. In this connection, a few decisions of the Supreme Court of the Republic of Croatia will be exposed to the issue of the allocation of illegal evidence, as well as the judgment of the European Court of Human Rights Lisica v. Croatia concerning the violation of the right to a fair trial.
