This paper deals with the issue of illegal evidence in civil and criminal proceedings. Since the subject matter is still being regulated in civil proceedings, this paper compares the regulation of illegal evidence in criminal proceedings, but also takes into account the provisions of the European Convention for the Protection of Human Rights and Fundamental Freedoms, the Constitution and other regulations to provide a valid solution to the above issue. The introductory part discusses the type of evidentiary prohibitions and their purpose, as well as a comparison of them with German and Austrian legislation. The topic of inadmissible evidence in civil law and illegal evidence in criminal law is discussed, and their similarity, but also a fundamental difference, is presented through case law. This paper provides an overview of the Draft Proposal of the Law on Amendments to the Law on Civil Procedure and the comments of the interested public and persons who should apply it on a daily basis in the performance of their duties or work. In the conclusion, the main part of the issue of regulating the concept of illegal evidence in civil proceedings is summarized and a proposal for its regulation is presented.
