Sažetak | U ovome se radu nastojalo dati konkretniji uvid u problematiku zaštite djece u oruţanom sukobu. U uvodnom je dijelu naglašena vaţnost afirmacije i ostvarivanja prava djece u oruţanom sukobu koja su i zajamčena brojnim meĎunarodnim i regionalnim deklaracijama i ugovorima. Budući se djeci jamče sva ta prava (na ţivot, slobodu, zabrana nečovječnog postupanja, pravo na obrazovanje, adekvatnu zdravstvenu zaštitu, id.), nuţno je da ona budu u potpunosti i poštovana kako u vrijeme mira tako i za vrijeme oruţanog sukoba. Daje se i definicija djeteta, odnosno djece vojnika kao osoba koje nisu starije od 18, odnosno u pojedinim slučajevima 15 godina, a sudjeluju u oruţanom sukobu, bilo izravno ili neizravno; potom se referira na meĎunarodne instrumente koji čine vaţan pravni temelj za zaštitu djece, ponajprije UN-ova Konvencija o pravima djeteta iz 1989. godine (s naglaskom na čl. 38 koji se odnosi na njihova prava u ovom specifičnom području; u okolnostima oruţanog sukoba) zajedno s protokolima koji uvelike pomaţu operacionalizaciji iste, pri čemu je za ovaj rad od posebnog značaja onaj glede uključivanja djece u oruţane sukobe (oba iz 2000. g.). Zatim se putem izvješća glavnog tajnika UN-a, posebice onoga o djeci i oruţanom sukobu u Demokratskoj Republici Kongo (iz 2014.) nastojalo oţivotvoriti ovu problematiku, ukazavši na ključne točke i goruće probleme za cijelu zajednicu na zaraćenom području, gdje UN-ovi suradnici nastoje zabiljeţiti sve prijestupe počinjene nad djecom te nastojanja posebnih misija, organizacija i timova da na razne načine i njima dostupnim sredstvima olakšaju ţivot djece u tako teškim uvjetima. Iako su u takvim okolnostima sva dječica krhka i ranjiva, u nekoliko se paragrafa ukazuje i na posebne potrebe te ranjivost djevojčica u oruţanom sukobu. TakoĎer se ističe i značaj i doprinos razvoja lakog i ručnog oruţja kada se govori o novačenju djece u oruţane snage i skupine te potrebi dodatne regulacije istoga na meĎunarodnoj razini. Ne smijemo izostaviti niti doprinos tijela UN-a, prvenstveno Vijeća sigurnosti, Opće skupštine, glavnog tajnika te Posebnog predstavnika za djecu i oruţani sukob. Oni imaju zadaću da na temelju konkretnog stanja pokušaju donijeti adekvatne preporuke, rezolucije, izvješća, izrade studije i planove za razvoj zaštite najranjivijih za vrijeme oruţanog sukoba te da javno prozovu počinitelje teških povreda nad djecom za vrijeme oruţanog sukoba te im ukaţu na prijestupe koje čine, ne libeći se birati sredstva kojima će ostvariti zadani im cilj te ukoliko takva vrsta prijekora, odnosno molbe i opomene da se s kršenjima prestane ne bude uvaţena i prihvaćena, postoje ovlasti zajamčene Poveljom UN-a da se pristupi i poduzme nešto radikalnije i ozbiljnije mjere, kao što su to razne zabrane i ograničenja koja oni imaju pravo postaviti drţavama članicama koje se ogluše na njihova upozorenja. Tu se prvenstveno radi o embargu na oruţje, potom zabranama ulaska i izlaska iz zemlje, raznim ograničenjima u trgovinskom smislu kako bi se financijski oslabile pojedine grupacije i subjekti koji sudjeluju u zloupotrebama, pri čemu se navodi kako time naţalost dolazi do ekspanzije tzv. crnog trţišta krijumčarenja oruţja, prodaje narkotika, i drugih vrijednih energenata (kao što su to primjerice nafta i drago kamenje) kako bi oni ipak došli do nekog izvora prihoda.
Budući oni imaju sva prethodno spominjana i zajamčena prava, ona bi se u potpunosti trebala poštovati kako za vrijeme mira, tako i u vrijeme oruţanog sukoba te ne bi trebalo dolaziti ni do kakvih povreda. MeĎutim, svi znamo kako je to u praksi nemoguće i neizvedivo te stoga treba reagirati i pokušati spriječiti i zaustaviti takvo što jer su djeca sama bespomoćna te ih se ne smije ostaviti da se sami bore protiv neumoljivog reţima i pravila jačega. Djeca su neprocjenjivo blago ovoga svijeta. Oni su budućnost. Budućnost koju neće imati ukoliko se ne bude teţilo da im se pomogne na svaki mogući način. |
Sažetak (engleski) | This paper tries to give an adequate and more accurate, detailed and specific inside preview to the issue about protection of children in armed conflict. Firstly, it points out childrens' rights proclaimed in many international and regional treaties and documents and the importance of affirmation and realization of the forementioned. Since they are all proclaimed (right to life, freedom, the prohibition of inhumane and degrading treatment, adequate health care, etc.) it is necessary that they are completely respected as during peacetime, also during the time when armed conflict takes place. It is also given the definition of a child, respectively a child – soldier as a person who is not older than 18, or in some cases 15 years and takes part in a conflict, whether directly or indirectly. Furthermore, it is being referred to international instruments which build an important legal basis for the protection of children, first of all the great UN Convention on the rights of the child from 1989. (with the emphasis on the article 38 which deals with their rights on this specific field; in the situation when armed conflict arises and takes place) together with optional protocols (both from 2000.) which helped with its operationalization in a great part; taking note that for this paper has an inadmissible importance the one referring to children taking part in armed conflicts. Moreover, throught the Reports of the Secretary General, especially quoting the one about the armed conflict in the Democratic Republic of the Congo from 2014.; it was intended to give a lifelike overview of this issue while pointing on crucial points and escalating problems of concern for the whole community on the territory affected with aremd conflict where UN's associates and collaborates try to mark all the breaches comitted against children and the attempts of special missions, organizations and teams to relief the life of the children which unintentionally, without their free will, live in this conditions, by all means that are on their disposure and using all the possible ways to help them. Although all the children who live in this kind of conditions are vulnerable, sensitive and fragile, there are few sections in this paper that point out the special needs and vulnerability of girls in the armed conflict situation. When we talk about the recruitment of child soldiers into armed foces and groups it is important to say that there is a huge impact of the development of easy weight and hand arms and that its usage and production shall be (more) precisely regulated on the international level. It is impossible to skip and forget the contribution of the UN's bodies, such as, primarily, the Security Council, the General Assembly, the Secretary General and the Special Representative for Children and Armed Conflict. They have the task, on the basis of a definite and real situation fact, to try to bring adequate recommendations, resolutions, reports, to draft studies and plans for the

development of the protection for most vulnerable at the time of armed conflict and to make public so called ''naming and shaming lists'' for those who make grave breaches against children during the time of armed conflicts. Furthermore, they need to show to the perpetrators all the violations that they committed while non choosing adequate measures and means while reaching their aims and targets. If the violators do not react on the warrnings to stop with the breaches, there are powers prescribed within the UN's Charter which allow it to recall on and use more radical and serious measures such as prescribing differents bans and limitations to the parties who are not willing to interact and collaborate peacefully. It is, firstly, dealt inhere with the embargo on arms, then the travel bans, various limitations in the trade market to make financially weaker some grupations and subjects which take part in the violations. Here we also have to say, that, unofortunatelly comes into effect the expansion of the so called ''black market'' related to arms smugglers, the sale of narcotics, and also, other important energents (such as petrol and diamonds) so that the perpetrators could reach, at least, some source income.
Since they have all of the aforementioned rights they should be completely respected as during the time of peace, also during conflict and war time and no violation shall occur, but we all know that this is impossible in practice and thus, we need to react and stop this kind of breaches, because alone, they are helpless and hopless; nothing is more worthy than one life saved. Children are the priceless treasure of this world. They are the future. For their brighter future, all of us; the community, shall stand and do everything possible to protect the children in armed conflicts. |
