This paper highlights the importance of legal drafting and its essential elements, which has not drawn a lot of attention in the Republic of Croatia so far. The paper emphasises the importance of proportionality in the simplicity and legal distinctness of a legal text in the process of drafting for the purpose of its clarity. The paper also presents objective requirements necessary for quality legal drafting, as well as subjective qualities of the drafters. With the purpose of drawing attention to imperfections in the legal drafting in Croatia, some defi ciencies are presented in the process of drafting and amending of the Utility Services Act. The process of drafting and amending of this Act is a good example of the way how legal drafting should not be done. It contains a lot of defi ciencies and failures that are the result of legal drafting mistakes. At the end, authors expect that the adoption of the Uniform methodology and nomotechnical rules for the drafting of acts enacted by Parliament should contribute to the higher quality of legal texts and to their full adjustment to the general requirements of legal certainty and rule of law.

Con il presente lavoro si tenta di porre l’attenzione sull’importanza della tecnica del drafting delle leggi e sui fondamenti dello stesso; questioni alle quali fi no ad ora nella Repubblica di Croazia non s’è prestata particolare attenzione. Si sottolinea l’importanza dell’individuazione della proporzione ottimale tra la semplicità e la determinatezza giuridica nel testo delle leggi nel corso del processo di stesura e di emanazione delle medesime, al fi ne del raggiungimento della loro comprensibilità e dell’adattabilità a tutti i soggetti cui sono rivolte. Nel lavoro si illustrano anzi tutto i presupposti oggettivi necessari per un buon uso delle tecniche di normazione; successivamente si disaminano le qualità soggettive cui deve rispondere il redattore della bozza di un testo normativo. A prova concreta delle mancanze presenti nel diritto croato, si analizza il processo di stesura, integrazione e modifi ca della Legge sulla gestione comunale dei servizi, che può servire quale valido esempio su come non vadano scritte le leggi, poiché in essa si osservano numerosi errori e mancanze, quali risultato di una sbagliata tecnica di drafting normativo. Alla fi ne si esprime l’auspicio che con l’emanazione delle Regole unitarie di metodologia e tecnica normativa per la stesura degli atti normativi da parte del Parlamento croato in futuro si contribuisca ad una maggiore qualità dei testi normativi ed al soddisfacimento delle pretese di certezza del diritto e di armonizzazione con il principio di imperatività della legge.
