Notary public as the commissioner of the court, based on the Enforcement Act, conducts involuntary collection of claims on the basis of enforcement title documents and trustworthy documents. Since the end of 2021, in the Republic of Croatia, the eOvrhe system has been in use, with the help of which creditors can submit the motion for enforcement to a notary public in order to collect claims from the enforcement debtor. The duty of the notary public is to evaluate whether the motion is permissible, send a notification on the debt to the enforcement debtor, issue an enforcement order, issue a suspension order, receive appeals, forward the motion for enforcement to the court and issue certificates of validity and enforceability of enforcement decisions. The notary public also has the right to request a fee for it, i.e., request from the enforcement creditor an advance payment for the costs of the proceedings upon entry of the case in the eNotar system and demand the payment of the remaining costs with regard to the fee after the enforcement order has been issued. This paper will research and present the historical development, duties and obligations of a notary public as the commissioner of the court, as well as the possibilities and authorities of the notary public during enforcement proceedings, which are limited by law. It will also indicate the problem of exploitation and misuse of such a system in the Republic of Croatia, but also in other countries of the European Union.
